1.1. This Refund and Returns Policy governs the terms under which WebFXMedia Agency (“We,” “Us,” or “Our”) processes cancellations, returns, and refunds for its Services, including all SEO, Web Design, Branding, and Subscription plans purchased via https://webfxmedia.agency/.
1.2. By purchasing any Service from Us, you agree to be bound by this Policy.
2.1. Nature of Services: Due to the nature of digital services, which involve immediate allocation of resources, customized work, and intellectual property (such as strategy development and consulting time), all fees paid for services are generally non-refundable.
2.2. No Refund for Performance: We do not guarantee specific rankings, traffic results, sales, or any other outcome from our SEO or marketing services. Refunds are not provided based on the perceived or actual performance of marketing campaigns.
2.3. No Refund for Delivered Work: Once work product (e.g., a website design, brand identity file, or SEO audit report) has been delivered, accepted, or moved into a functional/live phase, the payment for that service is non-refundable.
3.1. Subscription Plans: This section applies to all recurring plans (e.g., 3-month, 6-month, 12-month SEO subscriptions).
3.2. Cancellation: You may cancel your subscription at any time by notifying Us via email at support@webfxmedia.agency or through your client portal.
3.3. Effect of Cancellation: Your cancellation will take effect at the end of the current billing cycle (the paid term). You will not be charged for the following term, but no refund will be issued for the remaining days or months of the current, prepaid term. You will continue to receive the subscribed services until the term expires.
3.4. Annual/Long-Term Subscriptions: For subscriptions paid annually or for a term of six (6) months or longer, if you cancel within the first 14 days of the initial purchase date, you may be eligible for a refund, minus any costs incurred by Us for work already performed, third-party licensing, or platform setup fees.
4.1. Sole Exception: A full or partial refund may be considered only in the event of a material and demonstrable failure by WebFXMedia Agency to commence work as agreed upon in a signed service agreement or proposal, provided the failure is not due to factors outside of Our control (e.g., client delay, lack of access credentials, force majeure).
4.2. Client Delays: Delays caused by the Client (e.g., failure to provide content, feedback, or necessary access) do not constitute a failure to perform by Us and are not grounds for a refund.
4.3. Process for Refund Request: To request a refund under Section 4.1, you must: * Submit a detailed written request to support@webfxmedia.agency within 7 days of the alleged failure to perform. * Provide evidence detailing Our non-performance. * We reserve the right to remedy the non-performance within 14 business days before a refund is considered.
5.1. If you initiate a chargeback or other reversal of payment, We reserve the right to immediately suspend or terminate all services and access to any work product or intellectual property provided to you, until the payment dispute is resolved.
