1.1. These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“You” or “User”), and WebFXMedia Agency (“We,” “Us,” or “Our”), concerning your access to and use of the https://webfxmedia.agency/ website and any related applications, services, and digital products (collectively, the “Services”).
1.2. By accessing or using the Services, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.

2.1. Description of Services: WebFXMedia Agency is a digital marketing and web services provider offering a range of services, including but not limited to: Search Engine Optimization (SEO Audits, Management, Copywriting, Link Building, Site Migration), Web Design, UX/UI Design, Brand Identity, Web Development, Network Security, Remote Support, and Social Media Management.
2.2. Subscription Basis: Many of Our core services are offered on a subscription basis (e.g., Monthly, 3-Month, 6-Month, 12-Month plans). Your subscription begins on the date of purchase and continues for the term you selected.
2.3. Trial Periods: We may offer trial periods (e.g., “12h Test”). These trials are subject to specific terms presented at the time of purchase and may automatically convert to a paid subscription unless cancelled prior to the end of the trial period.
3.1. By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity and you agree to comply with these Terms; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not use the Services for any illegal or unauthorized purpose; and (6) your use of the Services will not violate any applicable law or regulation.
4.1. Pricing and Fees: You agree to pay all fees or charges to your account in accordance with the prices, charges, and billing terms in effect at the time a fee or charge is due and payable.1
4.2. Automatic Renewal: All subscriptions automatically renew at the end of the current term for an equ2al successive term, unless you cancel your subscription at least 5 days before the renewal date. You authorize Us to charge your chosen payment method for the renewal term.
4.3. Payment Methods: You must provide current, complete, and accurate billing and payment information. You authorize Us to charge your designated payment provider for all recurring fees.
5.1. Cancellation: You may cancel your subscription at any time by contacting us directly or through your account portal, if available. Your cancellation will take effect at the end of the current paid term.
5.2. Refund Policy: All sales are final. Please refer to our separate Refund and Returns Policy, available on the website, which governs all refunds and returns.
6.1. Our IP: All intellectual property rights in the Website, Services, and Our original content (excluding client materials) are owned by Us.
6.2. Client IP: You retain all ownership rights to any text, images, designs, or data you provide to Us for the purpose of receiving the Services (“Client Materials”). You grant Us a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the Client Materials solely for the purpose of providing the Services to you.
6.3. Work Product: Upon full and final payment for Services, We may, as defined in a separate Service Agreement (if applicable), transfer the intellectual property rights for the finalized, specific work product (e.g., a completed website or design assets) to you.
7.1. You agree not to use the Services to:
* Upload or transmit material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another’s privacy.
* Engage in any criminal or tortious activity.
* Interfere with or create an undue burden on the Services or the networks or services connected to the Services.
8.1. THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF.
8.2. We make no warranties or representations about the accuracy or completeness of the website’s content or the content of any websites linked to this site, and We will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage of any nature whatsoever, resulting from your access to and use of the Services.
9.1. IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.2. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE three (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
10.1. These Terms and your use of the Services are governed by and construed in accordance with the laws of the Kingdom of Morocco and the relevant courts in Casablanca shall have exclusive jurisdiction to resolve any dispute arising in connection with these Terms.
